By making a reservation with your personal information under NO circumstances will Michel Saumonneau sell or provide any of your personal information to third parties. To ensure comfort, safety and peace of mind all our homes are registered with the State Authorities and are in full compliance with all relevant legislation. All homes are privately owned and located in residential areas.
Any deposits, rent and fees paid shall become non-refundable if the reservation is cancelled by Guest.
If Tenant funds any portion of Security Deposit and/or rental fees outlined in this agreement by credit card, Tenant agrees to not initiate any “charge backs” to the funding credit card company in attempt to dispute such transactions involving payments to Owner. By accepting this agreement, Tenant confirms and consents to transactions to Owner by Tenant with regard to this rental agreement, and waives all rights to arbitration and litigation involving claims to dispute such transactions.
Check in time is after 4.00pm and check out is 10.00am. If you require a late checkout please arrange at the time of booking. The party is solely responsible for and shall secure all their personal property/belongings whilst in the rental property. The property owner/management company shall not be held responsible for any lost or stolen items. If rental home has an alarm please use this. The party leader further agrees to hold harmless and indemnify the property owner/management company for any loss, claims, costs, expenses or actions arising from their party’s use and occupancy of the rental property and pool. Please also understand that there is NO lifeguard on duty and that is a major condition of this reservation that the use of the rental property and pool area is entirely at your own risk. All pools have a maximum depth of 6ft, also horseplay and running around is strictly prohibited. You also agree that no children/adults non swimmers will use the pool without adequate supervision. The party leader also understands and agrees that neither the owner/management company can accept any responsibility whatsoever in case of accident or illness while in the property or use of pool. Any disputes under this agreement shall be resolved exclusively via binding arbitration according to the rules of the America Arbitration Association for commercial disputes in Osceola County, Florida, applying Florida Law. Each party shall pay their own attorney fees/costs and State of Florida shall have exclusive jurisdiction over any dispute Booking The signing of the booking form by the party leader ( must be 23 yrs old or older, photo ID may be required) confirms the acceptance of the terms /conditions and policies set out and shall be binding on the person(s) booking and intending to occupy the premises. Bookings cannot be taken from parties of your people under 23 years of age.
NO PETS/ANIMALS ACCEPTED. For the comfort of guests all homes are NO SMOKING. Your CREDIT CARD WILL BE CHARGE IF: people smoke in the house. or number of guests is not respected ( information that you put on the form )
All occupants of the Rental Property over the age of twenty-three (23) years shall be equally responsible for observing the Terms and Conditions specified in this Rental Agreement. Each adult occupant will be jointly and severally financially responsible for damage done to the Rental Property beyond normal wear and tear. The Tenant's signature certifies that occupants of the rental property over twenty-three (23) years of age have read this Agreement, and understands that breaches of any terms can and will result in credit card charge any additional costs. Number of guests cant be more than indicated on the reservation. Payment A 350 $ deposit is due once your reservation has been confirmed and NON REFUNDABLE. Payment of balance is due 45 DAYS prior to your arrival date. We do accept,credit card with Homeaway, VRBO $ personal checks and $ bankers checks, credit cards with paypal ( 5 % fees ).Checks are made payable to Michel Saumonneau.
This is a 89 $ fees Non refundable to cover any damage under 500 $, if any damage made up to 501 $ you will be responsible and charged for it.
It is understood and agreed between all parties that the Tenant and permitted occupants of the Rental Property will abide by the following terms and conditions, and that any breach thereof will, at the Owner's option, give the Owner the right to declare this Rental Agreement null and void, and said term ended, and the Owner shall have the right to re-enter the Rental Property and remove or have removed all persons there from, and in such event, Tenant agrees to forfeit all payments made on account of this Rental Agreement and all remedies and rights they may possess hereunder: ( a ) Guests: Unless prior arrangements have been made with Owner, no other persons shall occupy the Rental Property at any time, including overnight guests, except those indicated in this agreement and total indicated in initial reservation inquiry. Violation of occupancy limits (or evidence of additional guests upon departure cleaning or before) can and will result in all occupants being removed from the Rental Property, and forfeiture of Tenant’s rent and security deposit. (b) Noise: The Tenant shall not make or permit any excessive, disturbing or annoying noise in or on the grounds of the Rental Property by himself, his family, agents, servants or visitors, nor permit such persons to do anything that will interfere with the rights, comforts, or conveniences of neighbors or other persons in the surrounding area. No noise is permitted after 10:00 p.m. Parties or large gatherings are not permitted at anytime. (c) Consumption of Alcohol: There shall be no consumption of alcoholic beverages in or on the grounds of the Rental Property by any minor under twenty-one (21) years of age, and there shall be no congregation or drinking in property driveway, street, or adjoining areas surrounding the Rental Property. (d) Fire, smoking, candles and fireworks: Fire of any kind, including smoking and candle burning are PROHIBITED inside the Rental Property at all times. Smoking and candles shall be permitted only in the entry garden and outside pool area of the Rental Property. Evidence of discarded smoking materials on property grounds will result in deduction from security deposit. Fireworks are prohibited on the property (including the driveway) at all times. (e) Illegal Drugs: There shall be no use of any illegal drugs by any Tenants, occupants or visitors in or on the grounds of the Rental Property Swimming Pool: Tenant hereby acknowledges and understands that there are dangers and risks associated with the use of a swimming pool. NO CHILDREN UNDER THE AGE OF 10 ARE PERMITTED IN THE POOL AT ANY TIME WITHOUT ADULT SUPERVISION. NO DIVING IS PERMITTED. Further, Tenant understands that use of the pool is at their own risk and hereby fully waives and releases Owner from any and all claims for personal injury, property damage, or death that may result from the use of the pool or surrounding patio properties. During the winter months, tenant has the option to have the pool heated in advance for an additional expense of $210/week. Conversely, pool heating may be purchased after Tenant’s arrival by contacting the Booking agent or Owner. Tenant will be charged for any unauthorized electrical usage in connection with pool heating.

Pool Heat We are happy to provide the option of pool heat on many of our homes. To continue providing this service as cost effective as possible we ask that you read the following. 1 Pool heat is provided for an addition fee 2 It takes approximately 12-24 hours for the full warmth to be felt. A temperature of between 80-85 degrees can be expected with pool heat. 3 Pool pumps are on for approximately 8-10 hours per day 4 If the air temperature drops below 55 degrees many heaters will shut down as a safety precaution, which will obviously reduce the temperature of the pool. 5 Please under NO circumstances play around with the pool valves/equipment as not only can you unbalance the chemicals which are put in the pool for your safety but also you can damage the surface of the pool which could cost YOU thousands of dollars to get repaired.
We take every precaution to ensure that your pool heater functions correctly. However, like any mechanical device there are occasional breakdowns. If you pool heater breaks down we will make every effort to fix it in a timely manner. Credits for pool heat will be given if necessary based on the following criteria. We can only give credit for the days following notification of the malfunction till the time the malfunction is rectified. NO CREDITS can be given for the inconvenience of not having pool heat ( i.e cold weather). Power, water, phone & cable outages We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds will be given for any outages. Trash Place trash in outside receptacle, and leave by road for curbside pick-up. Refer to instructions in your rental property for the pick up days which are twice a week. Trash must be out by 6 AM on pick up days. If there is excess of trash on departure due to not putting out there will be a $ 25 pick up charge! GARBAGE DAY IS ONLY : MONDAY AND RE CYCLING : ONLY FRIDAY so please make sure that ALL trash is put out on pick up days. Pick up days are in each house folder. Homes for Sale. If a property should be on the market for sale that you are staying in, please be assured that NO ENTRY to show the house will be made during your stay Safety and Security To comply with State Fire Regulations, under NO circumstances must any more than the maximum number of persons identified on the booking form must occupy the property. Children must be supervised AT ALL TIMES whilst in pool area. No diving is allowed. The pool is used entirely at the guests own risk. Glass is not permitted in the pool area. Please use plastic items provided in the property. Force Majeure The owners and their management company accept NO responsibility or liability for any loss or damages or alterations to the terms of this booking, caused by events beyond the owners or management companies control including strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, act of god, closure of airports, adverse weather conditions, fire or flood.
The owners and management company do not accept responsibility for any accident, injury, illness or damage substained during the tenancy regardless of cause. You are advised to take full health and travel insurance.
Owner shall not be liable for events beyond Owner’s control which may interfere with Tenant’s occupancy of the Rental Property, including but not limited to acts of God, acts of governmental agencies, fire, strikes, war, inclement weather or noise from nearby construction sites. NO REBATE OR REFUND will be offered in these circumstances. Tenant fully understands that Kissimmee lies in a tropical rainforest climate, and that storms can impact vacation plans, transportation and other aspects of their vacation. If there is a storm or hurricane, no refunds will be given unless state or local authorities order mandatory evacuations in the area containing the Residence. In that case, Tenants will be refunded any unused portion of their rent. ASSIGNMENT, SUBLETTING, AMENDMENTS: This Agreement can only be changed by an agreement in writing by both the Tenant and the Owner. The Tenant may not assign this Rental Agreement or sublet the Rental Property under any circumstances.
A material breach of this Agreement by Tenant, which, in the sole determination of the Owner is incapable of remedy and results in damage to the Rental Property or contents thereof, personal injury to Tenant or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of this Agreement and Tenant’s tenancy hereunder. Violation of any of the terms or conditions contained herein will result in immediate eviction and forfeiture of all Rent and security deposits. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. Tenant may be evicted under such procedures if Tenant: (i) holds over in possession after Tenant’s tenancy has expired; (ii) commits a material breach of any provision of this Agreement that according to its terms would result in the termination of Tenant’s tenancy; (iii) fails to pay rent as required by this Agreement, or (iv) has obtained possession of the Rental Property by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments, and Tenant will not be permitted to take possession of the Rental Property.
This document, including any attachments incorporated by reference herein, constitutes the entire and sole agreement between Owner and Tenant with respect to the subject matter hereof, and correctly sets forth the obligations of Owner and Tenant to each other as of the date hereof. Any agreements or representations by Owner to Tenant with respect to the subject matter of this agreement not expressly set forth herein are null and void.
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida, and shall be treated as though it were executed in the County of Osceola, State of Florida. Any action relating to this Agreement shall be instituted and prosecuted only in the Osceola County Court, Florida. Tenant specifically consents to such jurisdiction and to extraterritorial service of process. Disclaimer LIABILITY – The property is privately owned and neither the owners nor the management company accept any responsibility whatsoever for personal injury, accidents, loss or damage to any persons or personal effects, however caused. The owners/management company reserves the right of entry at any time. This includes workers such as pool maintenance, gardener etc. Please remember that these homes are ALL SELF CATERING and NOT A HOTEL. If there is a problem at any time with the home please call the local management company of that home during office hours which are indicated in the house folder. ENJOY YOUR STAY.
